Is it right to sacrifice our life to get a pension and then being forced to share it with your ex-wife? If you think that, that’s a real injustice, avoid moving to Belgium. The Costitutional Court of Brussels, in fact, has recently ruled on a divorce case, in which the wife claimed to get the insurance that his partner stipulated during their relationship. Incredibly for the poor husband, the judges of the highest Belgian court accepted her claims. Indeed the couple was married with a common property regime. Because of this the pension which was to be recognized as a professional income and not as personal property, is fully part of the assets of the spouses. That is the reason why in the event of divorce it must be divided into equal parts.
