Judgment
Say no to the sombrero and to the veil

Public schools in Spain have the full right to prohibit the use of Islamic veil. It is determined by an Iberian court, that, with an unprecedented ruling, rejected the appeal of a student who considered the requirement to enter the classroom without the veil a real violation of freedom of worship. Argument that courts have deemed unfounded for two reasons. The first, according to national law, each school can decide its own rules that, in this case, prohibited without reference to faith and religious values, “the use of hats and any other garment that covers the head”. Second, it is stated in the judgment, there is now a well-established jurisprudence of the European Court of Human Rights which states that such bans do not affect freedom of religion to the extent that comply with Article 9 of the ECHR: “if necessary in a democratic society for the protection of public order, health or morals, or for the protection of the rights and freedoms of others “.
