Louise Hannon. This is the name of the first Irish transgender to win a causes for dismissal because of her new sexual identity. In fact according to the Dublin tribunal’s reconstruction when the applicant told his employers about sex change (male to female) and about the subsequent changing name she suffered real acts of harassment. In particular, Mrs. Hannon was forced to work at home, to keep in contact only by telephone with customers, to talk in a male voice and to introduce himself with his previous identity, only to be dismissed. However, according to the Irish courts, the society’s provisions and the end of the professional relationship constitute discrimination based on gender and contrary to national law (the Employment Equality Act “).The ruling also reports a similar case of European Court of Justice (Case C-13/94) that in1996 resolved as follows:”In view of the purpose of Directive 76/207 [...] dismiss a person intends to undergo, or has undergone, gender reassignment is to treat him or her unfavorably by comparison with persons of the sex to which he or she was deemed to belong before that operation.
