Father without rights

There is little to do. For the Italian Supreme Court, between custodial mothers and fathers with visitation rights the latter are always wrong. This time it is the case of a Polish man, whose former wife had brought away their son, when she moved to Italy in order to live with her new partner. An act deemed illegal by the Juvenile Court of Florence, who had ordered the immediate return of the child in the country of origin, not only because of the lack of the father’s consent, but also of the absence of a judicial act of authorization. However, the Supreme Judges were of different opinion. In fact, they agreed with the woman, for the simple reason that, in accordance with the national law, the parent with visitation rights can advance no claim on the children.
